TERMS AND CONDITIONS

Aqua Alliance Pty Ltd (ACN 662 508 296)

These Terms and Conditions apply to all Aqua Alliance events, services and registrations, including but not limited to AquaSummit, Industry Forums, Instructor Training Updates, webinars and other professional development offerings, as well as the sale of resources and the provision of consultations.

 

DEFINITIONS AND INTERPRETATION

In these Terms and Conditions:

  • “Aqua Alliance”, “we”, “us” or “our” means Aqua Alliance Pty Ltd (ACN 662 508 296).
  • “Event” means any Aqua Alliance event, program or service, whether delivered in person or online.
  • “Delegate” means any individual registered to attend an Event.
  • “Attendee” means any individual physically or virtually present at an Event, including delegates, guests, presenters, sponsors, or other participants.
  • “Group Booking” means a booking that meets the minimum participant number specified in the relevant promotional or registration materials for an Event.
  • “Organisation” means the entity making or paying for a Group Booking.
  • “Customer” means any individual or organisation that purchases or accesses Aqua Alliance resources, services or consultations, whether or not they attend an Event.
  • “Health and Fitness Requirement” means that each Delegate is responsible for understanding their own physical health and capability, and participation in any physical activity is voluntary.
 
HEALTH AND FITNESS REQUIREMENT

Some Aqua Alliance Events include physical activity components, including water-based and land-based activities. By registering for an Event, the participant acknowledges and agrees that they:

  • Are in good health and possess a level of fitness appropriate for participation.
  • Have disclosed any medical conditions or injuries that may affect their ability to safely participate.
  • Understand that activities may take place in deep or shallow water, on a pool deck, or in classroom environments.
  • Will comply with all instructions provided by Aqua Alliance staff, presenters, and venue personnel.
  • Understand that participation in physical activities is voluntary and undertaken at their own risk.
  • Release Aqua Alliance from liability for loss, injury, or damage arising from voluntary participation, to the extent permitted by law.
  • Authorise Aqua Alliance or venue personnel to seek medical assistance on their behalf if required and accept responsibility for associated costs.
  • Acknowledge that Aqua Alliance reserves the right to restrict or withdraw participation from any activity if a participant is deemed, at the organiser’s discretion, to be at risk of injury or to compromise the safety of others.

REGISTRATION

By registering for an Aqua Alliance Event, or purchasing any Aqua Alliance service or resource, and submitting payment, the registrant acknowledges and agrees that they:

  • Have read, understood, and agreed to these Terms and Conditions.
  • Understand that Event registration is confirmed only once full payment has been received, unless otherwise agreed in writing.
  • Accept that Aqua Alliance reserves the right to refuse or cancel registrations or services at its discretion, subject to obligations under Australian Consumer Law.
 
REFUNDS, CANCELLATIONS, AND CHANGES

To the extent required by Australian Consumer Law, delegates may be entitled to a refund if an Event is cancelled, rescheduled, or significantly relocated.

Aqua Alliance may update venues, schedules, session formats, presenters, or Event content to ensure the best experience for all delegates. Such changes do not affect the registration fee, except where required by law.

Delegates acknowledge that:

  • Auxiliary expenses, including travel, accommodation, meals, and parking, are not reimbursable. Delegates are encouraged to obtain travel insurance.
  • Refund requests must be submitted in writing and will not be considered without appropriate supporting documentation where required.
  • Subject to Australian Consumer Law, refunds may be available as follows:
  • 28 days or more prior to the Event: full refund minus an administration fee.
  • 14–27 days prior to the Event: 75% refund.
  • Within 14 days: refund requests will only be considered in cases of illness, death, or Force Majeure events, supported by appropriate documentation. Cancellations within 14 days without supporting documentation are not eligible for a refund or credit.
  • Administration fee: 6% of the registration fee (to be confirmed per Event) 
  • Partial attendance does not entitle delegates to a refund, except where required by law.
 
GROUP BOOKINGS

A Group Booking is defined as the minimum number of participants specified in the promotional and/or registration materials for each Event. These requirements will be published on the relevant Event registration page.

For approved Group Bookings:

  • One invoice will be issued to the Organisation.
  • Payment must be made in a single transaction unless otherwise agreed.
  • Each individual must complete their own registration using the designated Group Booking process or code within the timeframe specified.
  • It is the responsibility of the Organisation to ensure all individuals complete registration by published deadlines.
  • Group Booking arrangements may be amended or withdrawn for future Events.
  • Organisations may allocate their Group Booking across different Events, provided the minimum number of participants per booking is maintained.
  • Larger organisations or organisations with multiple sites may request partnership or negotiated rates by contacting Aqua Alliance in writing.
 
GROUP BOOKING TRANSFERS

Group Bookings are designed to encourage teams, organisations, businesses, and other groups to participate together and to provide a cost-effective way to attend an Aqua Alliance Event.

By making a Group Booking, the organisation agrees that:

  • The organisation accepts responsibility for managing all participant registrations included in the Group Booking.
  • Individual participants registered under a Group Booking are not eligible for separate or individual refunds; bank transfers may be permitted in accordance with these Terms and Conditions.
  • The nominated contact person for the Group Booking may request the transfer of a registration to another eligible participant within the group. All transfer requests, changes, substitutions, or cancellations must be submitted in writing by the original nominated contact.
  • Transfer requests must be received at least fourteen (14) days prior to the Event to allow sufficient time for administrative processing.
  • Aqua Alliance will communicate solely with the nominated contact in relation to the Group Booking, and all official correspondence must be submitted by that contact.
  • An administration fee, in accordance with the standard administration agreement, may apply to each approved transfer.
  • The organisation remains responsible for ensuring all replacement participants meet Event requirements.
  • Approved transfers or changes will be issued to the organisation, not to individual participants, unless otherwise agreed in writing.
 
FORCE MAJEURE

Aqua Alliance is not liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, pandemic, government restrictions, public health orders, natural disasters, war, terrorism, or venue closure.

In these circumstances, Aqua Alliance may postpone, modify, or cancel an Event. Delegates will be notified as soon as possible. Liability for auxiliary or consequential losses, including travel, accommodation, meals, or other expenses, is excluded to the extent permitted by law. Refunds will be managed in accordance with the REFUNDS, CANCELLATIONS, AND CHANGES section.

 

PUBLIC HEALTH AND INFECTIOUS DISEASES

All Events will comply with applicable government, health authority, and venue requirements. Registered delegates must not attend an Event if they are unwell or experiencing symptoms of illness, have tested positive for a communicable disease, are awaiting test results where isolation is required, or have been directed to isolate or quarantine. Personal details may be used for contact tracing purposes if required.

 

CODE OF CONDUCT

Aqua Alliance is committed to creating a safe, inclusive, and respectful environment for everyone. By enrolling or participating in an Event, all individuals acknowledge and agree that they will:

  • Behave professionally and conduct themselves responsibly at all times.
  • Treat others with respect, courtesy, and consideration.
  • Refrain from discrimination, harassment, vilification, bullying, or offensive behaviour on any basis, including but not limited to age, disability, sex, sexual orientation, gender identity, ethnicity, religion, pregnancy, or family responsibilities.
  • Avoid unwelcome verbal, physical, visual, or online behaviour that a reasonable person would find intimidating, offensive, or humiliating. This includes, but is not limited to:
  • Unwelcome comments or jokes
  • Unsolicited or unwanted contact
  • Threats or intimidation
  • Harassment related to personal attributes
  • Disruption of sessions or activities
  • Respect the personal identity, chosen name, and pronouns of all participants.
  • Contribute to a safe, positive, and inclusive atmosphere, ensuring equitable access and participation for all delegates.
  • Comply with instructions from Event staff or Aqua Alliance representatives regarding safety, conduct, or session management.
  • Understand that failure to comply with this Code may result in immediate action, including warnings, removal from sessions, expulsion from the Event without refund, or escalation through Aqua Alliance’s complaints process.
 
INTELLECTUAL PROPERTY AND RECORDING

By attending an Aqua Alliance Event, all attendees, participants, presenters, sponsors, and guests acknowledge and agree that:

  • All Event content, materials, and presentations are the intellectual property of Aqua Alliance or its presenters.
  • Attendees must not reproduce, record, or distribute full sessions without prior written permission from Aqua Alliance.
  • Short recordings (for example, up to 90 seconds) may be shared only if other attendees are not identifiable without their consent.
  • Use of Aqua Alliance trademarks, logos, or branding without prior written permission is strictly prohibited. 

 

PHOTOGRAPHY, VIDEO, AND AUDIO

By attending an Aqua Alliance Event, all attendees, participants, presenters, sponsors, and guests acknowledge and agree that:

  • Photography, video, and audio recordings may be taken during Events for promotional and informational purposes.
  • By attending, individuals grant Aqua Alliance permission to use their image or likeness and recordings.
  • Individuals who do not consent to the use of their image or likeness must notify Aqua Alliance prior to or at registration or entry.
  • Aqua Alliance will make reasonable efforts to respect and accommodate requests regarding non-consent.
 
RESOURCES AND CONSULTATIONS

Where a Customer purchases resources or engages Aqua Alliance for consultations or advisory services, the Customer acknowledges and agrees that:

  • Delivery timelines, scope, and outcomes will be as agreed at the time of purchase or engagement.
  • Refunds are not available once digital resources have been accessed or consultations have commenced, except as required under Australian Consumer Law.
  • Advice provided is general in nature and does not constitute legal, medical, or financial advice.
  • All materials remain the intellectual property of Aqua Alliance and may not be shared, reproduced, or resold without prior written permission.
 
FEEDBACK, COMPLAINTS, AND GRIEVANCES

Feedback and complaints are welcomed and will be handled professionally. Complaints may be submitted via the website contact form, by email, or in person at an Event. Anonymous complaints are accepted. All information provided will be treated confidentially unless disclosure is required by law.

The Directors and Event Management team are responsible for ensuring all complaints are investigated, documented, and resolved fairly, and outcomes are used to improve future Events.

 

ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between Aqua Alliance and the Delegate and supersede all prior communications or representations relating to the subject matter.

 

GOVERNING LAW

These Terms and Conditions are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction.
