TRADEMARKS 

Aqua Alliance Pty Ltd (ACN 662 508 296) is an Aquatic Fitness company that powers education for aqua professionals through events including but not limited to Industry Forums, Webinars, AquaSummits and other learning opportunities.  

“We”, “us”, and “our” refers to Aqua Alliance Pty Ltd and Aqua Alliance events and are protected by applicable intellectual property and other laws, including, but not limited to, copyright.  This agreement sets forth terms, conditions, requirements, and clauses relating to the interaction on, and the use of, our website and social media platforms, all services sold and attendance at the AquaSummit events.   The Aqua Alliance Registration Requirement, Health and Fitness Requirement, Customer Refunds, Cancellations,  Application, Code of Conduct, Feedback, Complaints and Grievances and WebsiteIP and photography details are included in this agreement.  Further information regarding our Privacy Policy can be found on this website.

REGISTRATION

Thank you for taking the time to read the following conditions before registering and paying for an Aqua Alliance event.   

Before paying for an event or service, you will be asked to accept these terms and conditions by clicking on the “I accept” button at the shop.  This means you will have accepted the following conditions of sale. You should not accept registration nor make payment unless you agree with these Terms and Conditions. 

HEALTH & FITNESS REQUIREMENT 

AquaSummit sessions include best practice standards to safeguard the health and interests of delegates partaking in any physical activities as part of this professional development event.

 Upon registration, you declare and warrant that;

  • You are in good health and physical fitness at the time of registering to attend AquaSummit and Industry Forum events.

  • You recognise that AquaSummit sessions involve physical activities which may require a reasonable level of fitness.  The activities may be carried out in both deep and shallow water, on the pool deck, or in a lecture/classroom setting

  • You will follow the directions of the event organisers and venue personnel when partaking in any physical activity during the sessions

  • You agree to take full responsibility if you choose to partake in the physical interactive components of the AquaSummit event.  Additionally, you agree to assume any risk that is associated with participating in the event and release Aqua Alliance from any and all claims of damage and loss as a result of participation. 

  • You authorise Aqua Alliance or the AquaSummit and Industry Forum venue personnel to obtain medical assistance they may deem necessary should any medical problem or accident occur, and agree to pay all medical expenses incurred on your behalf.

Please note that it is optional to partake in all physical elements of the AquaSummit event.

REFUNDS, CANCELLATIONS AND CHANGES

To the extent permitted by law, including the Australian Consumer Law (ACL), you may be entitled by law to a refund where an event is cancelled, rescheduled or significantly relocated. 

On payment of an Aqua Alliance event, you will be asked to indicate that you have read this document in regard to refunds and in accordance with any cancellation of your registration and all other liability is expressly excluded.   

We may add, withdraw or substitute Presenters or vary advertised sessions or times as deemed necessary.  Registration will not be exchanged or refunded because of these changes, except as provided and required by law, including the ACL.

Event venues may have limited capacity, particularly for the practical in-water session; this often results in many of our events selling out.  For this reason, we ask that if you need to cancel your registration, you do so as early as possible prior to the event.   This will allow us to offer your place to another delegate and provide you with a refund. 

REFUND APPLICATION

Non-attendance at an event disadvantages other delegates when places are limited.  For this reason, refunds without supporting evidence will not be considered. You may however cancel your registration in accordance with these Terms and Conditions if notification is received;

  • at least 28 days prior to the event, we will refund your registration payment minus administration costs.

  • between 14 - 28 days, we will refund you 75% of your registration fee.

  • If you cancel within 14 days of the AquaSummit due to circumstances involving illness, death, or Act of God events, you must email [email protected] to request a refund. You must provide supporting evidence of the reason for cancelling which may include a medical certificate or statutory declaration of personal circumstances. 

To the extent permitted by law including ACL, we will not reimburse you for auxiliary expenses (such as the cost of travel, car parking, child-care, and accommodation) or other consequential loss suffered by you in connection with your attendance or non-attendance at an event. We recommend that you obtain travel insurance for those expenses.

COVID-19 

We are bound to consider stipulations from Government, Health Authorities and venue processes and procedures in relation to Covid-19. Aqua Alliance or an AquaSummit venue may make your entry conditional upon agreeing to answer questions from the event or medical staff prior to entering or partaking in the event.   

You must not  attend an event if:

  • you are sick or suffering any COVID-19-related symptoms

  • you are awaiting results for, or have tested positive to, COVID-19

  • you have been advised to self-isolate or quarantine

If you cannot attend the event due to this clause, please contact us before the event to discuss options.

At an Aqua Alliance event, you must stay within designated areas, maintain good hand hygiene and a 1.5m social distance between each person in the pool/lecture room, toilets, and other common areas.  We will not be responsible for any claim or accept liability if you acquire COVID-19 due to your attendance at the event.

If we cancel an event for any reason in connection with COVID-19, you will be entitled to a refund.  In the case of any delegate at the event testing positive for COVID-19 or suspected of having COVID-19, your personal information may be used and disclosed for the purposes of contact tracing.

CODE OF CONDUCT

Aqua Alliance is guided by the highest ethical and professional standards to ensure a safe environment for everyone. This Code of Conduct applies to all people including, but not limited to, registered delegates, Invited guests, presenters and speakers, event staff and contracted services, volunteers, sponsors, exhibitors and advertisers of Aqua Alliance services and an Aqua Alliance event.  We expect persons to behave with integrity and respect toward the collective of people using Aqua Alliance services or attending an Aqua Alliance event.  

Organisers will adhere to this code in the lead up to, and throughout the event to ensure a safe environment for everyone involved at all times.  We are proud to be a harmonious collective for sharing information and will provide a harassment-free experience for everyone.  Harassment can be against the law when a person is treated less favourably. Delegate incidents can be safely addressed to organisers at an event or via the Feedback, Complaints and Grievances policy.  

Harassment includes, but is not limited to, offensive verbal or written comments related to gender, gender identity and expression, age, sexual orientation, disability, physical appearance, race, ethnicity, religion, and technology choices.  Harassment also includes sexual, graphic or culturally inappropriate images in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, inappropriate or unwanted physical contact, unwelcome sexual attention, and advocating for, or encouraging any of the above behaviours.

We do not tolerate harassment of any form.  People involved with an Aqua Alliance event violating these rules may be sanctioned or expelled from our events (without a refund) at our sole discretion.  

FEEDBACK &  COMPLAINTS

This section applies to all feedback and complaints received by Aqua Alliance customers, including but not limited to those related to customer service, products, services, policies, and procedures.

All feedback and complaints will be handled in a timely and professional manner and the individual will be kept informed of the progress of their complaint. The Directors of Aqua Alliance are ultimately responsible for ensuring that the policy is followed, and that all complaints are dealt with appropriately and in accordance with the merit of the complaint.

Submitting Feedback and or Complaints

Feedback or complaints may be made 

  • in person at an Aqua Alliance event 

When submitting a complaint to Aqua Alliance, it is important to provide detailed information about the issue and, if possible, include any relevant documentation or records with specific dates and times. All information provided in the complaint will be kept confidential, except in cases where it is required by law or other appropriate circumstances. Anonymous complaints will also be taken seriously and handled in the same manner as any other complaint.

Aqua Alliance is committed to working with individuals to reach a fair reasonable resolution in a timely manner. Aqua Alliance's Management and Event Team will be trained and responsible for the investigation, resolution, and documentation of all complaints received by the organisation.

Management of the Feedback and Complaints

Aqua Alliance's Management and Event Crew will be trained and responsible for the investigation, resolution, and documentation of all complaints received by the organisation. They will acknowledge and record the complaint immediately and ensure the details are correct by verifying them with the complainant.

Aqua Alliance will also be responsible for regularly reviewing and updating the Feedback and Complaints Policy as necessary. Aqua Alliance will maintain all complaint records for a period of seven years. Aqua Alliance will also ensure that all complaint details are collated to show improvement and detail how the complaint data is used for the betterment of the organisation and service delivery. Where there is a repeated complaint issue, the organisation will investigate the best way to mitigate the complaint and resolve the issue.

WEBSITE, INTELLECTUAL PROPERTY & PHOTOGRAPHY

The Aqua Alliance website includes registered trademarks and other trademarks protected by law.  Except as expressly authorised, the use or misuse of any of these trademarks is prohibited.  You agree that your access to, and use of, this site is subject to these terms and all applicable laws.  

You agree that the services, images, audio clips, video clips, and written content used by us contain proprietary information and material that is owned by us and is protected by applicable intellectual property and other laws, including but not limited to copyright.  You agree that you will not use such proprietary information or materials in any way except in compliance with these Terms and Conditions. No portion of our content may be reproduced in any form or by any means without our written permission. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on our services in any manner, and you shall not exploit us in any unauthorised way whatsoever.

Please note that photographs, video, audio clips and electronic images may be taken during your attendance and participation at an Aqua Alliance event and, as such, are owned by us and may be used for promotional or other purposes without consent being obtained.  You agree to notify us prior to registering for an Aqua Alliance event if you do not consent.   

You agree that you will not use or modify any photographs, video, audio clips and electronic images to sell, distribute, loan, or create derivative works based on the Aqua Alliance services in any manner and shall not exploit them in any way.  All professional development content is considered Aqua Alliance intellectual property and, therefore, cannot be filmed in its entirety for selling or individual purposes. Videos (maximum of 60 seconds) can be posted on social media.

APPLICABLE LAW

These Terms and Conditions shall be construed and governed by the laws of Victoria, Australia. Further, any dispute arising from these Terms and Conditions or a breach of any agreement between you and us will be governed by the laws of Victoria, Australia. As a user of this website and our services, you submit to the exclusive jurisdiction of the courts of Victoria, Australia and the federal courts of Australia.
